Patrick Leahy is far from some obscure, minor legislator from East Pigknuckle. This guy's a major mover and shaker in DC.

Senate Judiciary Chairman Unable to Say Where Constitution Authorizes Congress to Order Americans to Buy Health Insurance

(CNSNews.com) – Senate Judiciary Chairman Patrick Leahy (D-Vt.) would not say what part of the Constitution grants Congress the power to force every American to buy health insurance--as all of the health care overhaul bills currently do.

Leahy, whose committee is responsible for vetting Supreme Court nominees, was asked by CNSNews.com where in the Constitution Congress is specifically granted the authority to require that every American purchase health insurance. Leahy answered by saying that “nobody questions” Congress’ authority for such an action.

CNSNews.com: "Where, in your opinion, does the Constitution give specific authority for Congress to give an individual mandate for health insurance?"

Sen. Leahy: "We have plenty of authority. Are you saying there is no authority?"

CNSNews.com: "I’m asking--"

Sen. Leahy: "Why would you say there is no authority? I mean, there’s no question there’s authority. Nobody questions that."


When CNSNews.com again attempted to ask which provision of the Constitution gives Congress the authority to force Americans to purchase health insurance, Leahy compared the mandate to the government’s ability to set speed limits on interstate highways--before turning and walking away.CNSNews.com: "But where, I mean, which–"

Sen. Leahy: "Where do we have the authority to set speed limits on an interstate highway? The federal government does that on federal highways."

CNSNews.com: "The states do that."

Sen. Leahy: "No. The federal government does that on federal highways."


Prior to 1995, the federal government mandated a speed limit of 55 miles an hour on all four-lane highways. The limit was repealed in 1995 and the authority to set speed limits reverted back to the states.

Unfortunately, such a precedent has already been established with Medicare. If people upon attaining age 65 don't sign up for Medicare, subsequent efforts to sign up incur a permanent penalty that increases with each year after age 65. This penalty is in the form of a % added to Medicare's monthly premiums, even though the individual over his or her working life paid into the Medicare program in the form of a payroll tax analogous to social security.

Leahy and his crowd are a bunch of totalitarians at heart.

IIRC, Leahy (or his staff) was also responsible for a number of national-security "leaks" back about 10-15 years ago.

He's more than a little dangerous to the Republic.

Leahy is a disgrace to both the truth and the United States, and should be put in prison for treasonous thoughts, with his pension as bail.

The 55 limit did not require the states to comply, but persuaded them by hooking it to the granting of highway repair funds.

Also the 55 law may not ever have been tested in the Supreme Court.

Third, it was signed by the then president, who is not a member of Congress. Leahy is doing nothing more than lying and attempting to deceive people, which is evidently the basis of his career.

Wonder if anyone at CNN will fact check this as they were so eager to try and do for SNL segment? Here is the chairman of the judiciary committee and he selected the issue to chose as an example. How about at least treating this as they might if Sarah Palin had said it.

Of course they do have some authority because if the states do not do what they tell them, they cut off funds for highways. So they have the authority to committ blackmail. Maybe that is what he considers having authority.

Most of us will live longer than most of those zombies in Congress. Btw, not to sound cruel or anything, but has there ever been a TV show that goes around to former elected officials who are in their dotage and interviewed them to find out what they're really like?

Hey, wait, I detect something sinister in Leahy's "federal highway" phrase.

Does the federal govt own some of the highways? If so, how long before they lease them out to the UN? Has anybody seen any highway patrol officers wearing UN blue hats?

I've seen foreign military convoys on US roads in Calif ... One of them was obviously the Danish army and they looked like they had made a wrong turn, as they were not on even a state highway at the time. Dang, I should have called the county sheriff on these guys and scared the heck out of 'em.

There is often military convoy activity in these parts, but it's normally USMC and on the freeway.

Heck! I think it was the State gov't of Texas that tried to lease a portion of a state highway to the Red Chinese to manage. Or perhaps it is a new road to be built? It will be a toll road. I don't know if it ever came off, but a foreign gov't owning a potentially strategic piece of the USA kinda scares me.
